Health Data Consent

Under Art. 9(2)(a) GDPR and Art. 6(7) of the Swiss Federal Act on Data Protection we need your explicit consent before PulsQue may process health data about you. Health data belongs to the special categories of personal data and enjoys particular protection. Without this consent all health-related features remain blocked; signing in, exporting your data and deleting your account remain available to you regardless.

The controller is Benjamin Dudli, sole proprietorship, Adresse auf Anfrage (address on request), Switzerland, info@pulsque.com.

Which data this covers

  • Body weight, BMI, body circumferences and other body measurements
  • Nutrition behaviour, meals, calorie and nutrient values
  • Training sessions, exercises, sets, loads and training notes
  • Sleep data as well as steps and active calories
  • Blood pressure, heart rate, resting heart rate and heart rate variability
  • Cycle, bleeding, symptom, mood and energy data
  • Injuries, complaints, medication and health-related notes
  • Supplements, intake records and health-related plans
  • Body photos and the associated body and time metadata
  • Your conversations with the AI coach insofar as they relate to health

If you enable the import from Apple Health or Android Health Connect, this consent also covers the values taken from there. Which categories are taken over is additionally decided by you in your device's permissions. No data flows back from us to Apple or Google.

What we use this data for

  • Recording, storing, synchronising and visualising your health, nutrition and training history
  • Calculating and adjusting personal goals, plans, reminders and recommendations
  • Detecting trends and generating the analyses and coach responses you request
  • Cross-device backup and restore, and protection against data loss and unauthorised access

Processing by AI service providers

Part of these features runs through AI service providers outside Switzerland and the EU. This concerns the AI coach, the analyses of your nutrition and training data, meal recognition from photos, the voice capture of meals, and the generation of recipe and exercise content.

  • Recipients: OpenRouter Inc., United States, as the intermediary to the respective model provider; for individual features additionally Google LLC, United States.
  • Purpose: generating the response, analysis or recognition you have requested.
  • Data categories: depending on the feature, nutrition and training values, body measurements, goals, photos of meals as well as what you write to the coach yourself. Name, email address and postal address are not transmitted.
  • Third-country transfer: the basis is standard contractual clauses under Art. 46(2)(c) GDPR.
  • Retention: the request is transmitted for the duration of the processing and is not stored by us at the provider. The result stays in your account until you delete it or your account.

You determine which data categories the AI coach may use in the settings under Privacy; that selection is enforced server-side. If you withdraw this consent, the health-related AI features cease to be available.

What this consent does not permit

This consent does not permit the processing of genetic data, nor the processing of laboratory findings or blood values from medical documents. Both features have been removed from PulsQue.

Your right to withdraw

You can withdraw this consent at any time with effect for the future — in the app under Settings, Privacy. Withdrawal triggers the deletion of the operational health data collected. Legally required, access-restricted records of the consent itself may be retained; they contain no health values, only version, language, app version and timestamp. The lawfulness of processing carried out before withdrawal is unaffected. You suffer no disadvantage from refusing or withdrawing beyond the health features being blocked.

Your declaration

I expressly consent to PulsQue processing the health data listed above for the stated tracking, personalisation, analysis and synchronisation purposes. I also expressly consent to the values required for this being transmitted to the AI service providers named above in the United States. I understand that I may withdraw this consent at any time.
